These Terms & Conditions govern your relationship with Daily Grocer and apply to all transactions, activities, and services associated with being a vendor on our platform.
2. Eligibility
To become a vendor on Daily Grocer, you must:
- Be a legally registered business entity or individual in compliance with local laws and regulations.
- Have the ability to provide goods for sale that meet the quality and safety standards.
- Have valid business registration and permits required by your local jurisdiction.
- Be authorized to sell the products you offer on Daily Grocer.
3. Registration Process
- Account Creation: Vendors must create a Daily Grocer vendor account by providing accurate and complete information, including but not limited to business name, contact details, business type, and relevant licenses.
- Verification: Daily Grocer reserves the right to verify all information provided during registration. This may include reviewing business documents, product samples, and compliance with local laws.
- Approval: Vendors will receive confirmation via email once their account has been approved. You may be required to complete additional steps depending on the category of goods sold.
4. Vendor Responsibilities
- Product Listings: Vendors must ensure that product listings are accurate, clear, and reflect the current state of inventory, pricing, and descriptions. It is your responsibility to regularly update this information.
- Pricing: You agree to set reasonable and competitive prices for your products. Daily Grocer may review and approve pricing to ensure fairness and compliance with our platform standards.
- Product Quality & Safety: All products must meet industry standards, safety regulations, and health requirements. Vendors must only offer products that are legal for sale and fit for consumption, where applicable.
- Shipping & Delivery: Vendors are responsible for fulfilling orders in a timely manner and ensuring accurate delivery details. Vendors must honor all shipping terms and delivery dates agreed upon with customers.
- Customer Service: Vendors must provide prompt and courteous customer service, including managing returns, refunds, and complaints according to Daily Grocer’s policies.
5. Daily Grocer Responsibilities
- Platform Management: Daily Grocer will provide a platform for you to list and sell your products. We ensure that the platform is operational and secure for all transactions.
- Transaction Processing: Daily Grocer will manage payments, refunds, and commission processing for all orders placed through the platform.
- Marketing Support: We may provide marketing support and visibility options to vendors to help drive sales but do not guarantee sales volume.
6. Commission & Fees
- Commission Rates: Daily Grocer charges a commission fee based on the total value of each sale, which will be deducted before payment is made to the vendor. Commission rates may vary depending on the product category and the type of vendor account.
- Payment Terms: Payments will be made on a weekly/bi-weekly/monthly basis (depending on the agreement). Vendors are responsible for ensuring their payment details are up-to-date in their Daily Grocer vendor account.
- Refunds and Chargebacks: In the case of a return, refund, or chargeback, vendors are responsible for handling the financial implications, including the return of the product and the associated costs.
7. Intellectual Property
- Product Rights: You confirm that you have the necessary rights to the products you list and that your products do not infringe on the intellectual property rights of others.
- Content Rights: You grant Daily Grocer the right to use your product images, descriptions, and other content for promotional purposes on the platform and through other marketing channels.
- Branding: Vendors are responsible for ensuring that all branding, marketing, and promotional materials comply with applicable laws and are not misleading to customers.
8. Compliance with Laws
Vendors must comply with all applicable local, state, and international laws, including but not limited to:
- Consumer protection laws
- Data privacy and protection laws
- Health and safety regulations
- Taxation and financial reporting requirements
9. Termination of Vendor Account
- By Vendor: You may terminate your account by submitting a written request through the Daily Grocer vendor dashboard. All pending orders must be fulfilled prior to account deactivation.
- By Daily Grocer: We may suspend or terminate your vendor account if you violate these Terms & Conditions or engage in illegal or unethical conduct. Daily Grocer reserves the right to suspend or remove any vendor account at its sole discretion, without prior notice, for any breach of this agreement.
10. Limitation of Liability
- Daily Grocer is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform, including loss of profit, business interruption, or damage to reputation.
- You acknowledge that your use of Daily Grocer is at your own risk, and we are not responsible for any loss or damage that may result from your failure to comply with these Terms & Conditions.
11. Dispute Resolution
- Arbitration: Any disputes between Daily Grocer and the vendor shall be resolved through binding arbitration in accordance with the rules of [Insert Arbitration Body].
